Arizona 20-week abortion ban upheld by U.S. judge

A federal judge on Monday upheld the constitutionality of a tough new abortion law in Arizona, which imposes restrictions on doctors seeking to end a pregnancy well before a fetus can survive on its own outside a mother?s womb.

The restrictions, which were signed into law in April, made Arizona the 10th state to pass a ban on abortion at the 20- week stage? three to four weeks before so-called fetal viability.

Lawyers challenging Arizona?s statute had argued that US Supreme Court precedent says women have a constitutional right to end their pregnancy at any time prior to fetal viability.

But US District Judge James Teilborg said the statute, HB 2036, did not impose a substantial obstacle to woman?s constitutional rights. He said the law is justified by evidence that a fetus can feel pain as soon as 20 weeks after conception.

?While HB 2036 may prompt a few women, who are considering abortion as an option, to make the ultimate decision earlier than they might otherwise have made it, HB 2036 is nonetheless constitutional because it does not prohibit any woman from making the ultimate decision to terminate her pregnancy,? the Phoenix-based judge wrote in a 15-page decision.

?In choosing to put a limit on abortions past 20 weeks gestational age, the Arizona Legislature cited to the substantial and well-documented evidence that an unborn child has the capacity to feel pain during an abortion by at least 20 weeks gestational age,? he said.

?[Arizona officials] presented uncontradicted and credible evidence to the court that supports this determination,? the judge said.

The ruling clears the way for the law ? and its new restrictions -- to take full effect on Thursday.

Lawyers with the American Civil Liberties Union and the Center for Reproductive Rights said they would file an emergency appeal asking the Ninth US Circuit Court of Appeals to overturn the ruling.

?Today?s decision casts aside decades of legal precedent, ignoring constitutional protections for reproductive rights that have been upheld by the United States Supreme Court for nearly 40 years and threatening women?s health and lives,? Nancy Northup, president of the Center for Reproductive Rights, said in a statement.

The ACLU and CRR filed suit July 12 seeking to block the statute before it could take effect.

The law bars physicians from performing an abortion after 20 weeks, except in cases of a ?medical emergency.? The statute defines medical emergency as a condition that requires an immediate abortion ?to avert [a patient?s] death or for which a delay will create serious risk of substantial and irreversible impairment of a major bodily function.?

Lawyers challenging the statute said it undermines efforts to safeguard the health and safety of women.

?This law forces a sick, pregnant woman to wait until she is on the brink of disaster before her doctor can provide her medically appropriate care,? said Dan Pochoda, legal director of the ACLU of Arizona.

Other states that have similar restrictions are North Carolina, Nebraska, Alabama, Idaho, Indiana, Kansas, Oklahoma, Georgia, and Louisiana.

A British man who joked on Twitter that he would blow up an airport after it closed because of snow has had his conviction for sending a "menacing" message overturned in a landmark ruling for users of social media websites.

Paul Chambers, 28, had sent the message in what he called a moment of frustration at not being able to catch a flight from Doncaster Robin Hood airport.

He had later been arrested and sentenced but the High Court on Friday upheld his appeal against conviction.

Speaking outside the court afterwards, Chambers' lawyer John Cooper, who had argued it was wrong to associate the tweet with terrorism, said it was a milestone ruling.

"It's a very big decision both nationally and internationally for hundreds of thousands, if not millions of people who use Facebook and Twitter," he told the BBC.

"It means that if you intend to make a joke and if what you do is a joke, however bad a joke that is, you cannot be prosecuted," he added.

The case revolved around a tweet sent by Chambers to a friend in January 2010, which read: "Crap! Robin Hood Airport is closed. You've got a week and a bit to get your shit together, otherwise I'm blowing the airport sky high!"

Chambers said he sent the tweet to his 600 followers in a moment of frustration and never imagined it would be taken seriously.

"It was surreal. My world became something else," he said when asked how he felt when he was arrested.

Of Friday's ruling he added: "It's an important decision as far as social networks are concerned and as far as Twitter is concerned.

"It has established that there has to be an action that is menacing and is intended to be menacing."

Chambers' case gained the attention and support of thousands of Twitter users and several high-profile British comedians.

In Friday's High Court ruling, three judges headed by the Lord Chief Justice Lord Judge, allowed Chambers' appeal against a Crown Court judge's decision upholding the 2010 conviction.

They said: "If the person or persons who receive or read it, (the message) or may reasonably be expected to receive, or read it, would brush it aside as a silly joke, or a joke in bad taste, or empty bombastic or ridiculous banter, then it would be a contradiction in terms to describe it as a message of a menacing character."

Aging AIDS epidemic raises new health questions

WASHINGTON (AP) ? AIDS is graying. By the end of the decade, the government estimates, more than half of Americans living with HIV will be over 50. Even in developing countries, more people with the AIDS virus are surviving to middle age and beyond.

That's good news ? but it's also a challenge. There's growing evidence that people who have spent decades battling the virus may be aging prematurely. At the International AIDS Conference this week, numerous studies are examining how heart disease, thinning bones and a list of other health problems typically seen in the senior years seem to hit many people with HIV when they're only in their 50s.

"I'm 54, but I feel older," said Carolyn Massey of Laurel, Md., who has lived with HIV for nearly 20 years.

"When I hear young people talk about, 'Well you get HIV and you take your drugs and you'll be all right' ? that's just not the truth," she said. "This is a lifelong thing we're talking about, and it unfolds every day on you."

The graying isn't just because people like Massey are surviving longer. Some of it comes from older adults being newly diagnosed, a trend U.S. health officials say is small but slowly growing. Yes, grandparents still have sex ? and that's an age group missed by all those hip safe-sex messages aimed at teens and 20-somethings.

"They let down their guard," is how Dr. Kevin Fenton of the Centers for Disease Control and Prevention puts it.

Already, a third of the nearly 1.2 million people living with HIV in the U.S. are over 50, and by 2020 half will be, Fenton said at one of numerous sessions on aging at the world's largest AIDS meeting.

People 50 or older accounted for 17 percent of new HIV diagnoses in 2009, according to the CDC's latest data. That's up from 13 percent in 2001.

There aren't as good counts in poor regions of the world, where access to life-saving medications came years later than in developed countries.

But even in hard-hit sub-Saharan Africa, home to most of world's HIV-infected population, studies suggest 3 million people living with HIV are 50-plus, said Dr. Joel Negin of the University of Sydney in Australia. By 2040, he said, that could reach 9 million.

There, challenges are different. Ruth Waryaro of Kenya, addressing the conference on her 65th birthday, said clinic workers hassle her when she goes to pick up her monthly supply of medication ? not believing a grandmother really needs it.

"If you're not strong enough, you just leave the medication and go home," said Waryaro, who raised four children of her own and now is raising four AIDS orphans. She also has diabetes and high blood pressure.

As Negin pointedly told the conference, "50 is not old." But for years, world health authorities didn't even measure HIV in people beyond age 49.

Today, people who are diagnosed and treated early can expect a near-normal life-span, Dr. Anthony Fauci, infectious disease chief at the National Institutes of Health, told The Associated Press.

The new focus is on what these pioneering survivors can expect as they reach their 50s, 60s and beyond. They're now getting chronic illnesses such as heart disease, diabetes, kidney disease and osteoporosis ? some of the common ailments when anyone gets old. But studies suggest people with HIV may be at higher risk for some of those illnesses, or get them earlier than usual.

"It's almost created a new subspecialty of medicine," Fauci said.

Perhaps the strongest evidence links HIV and an increased risk of heart disease. Some AIDS medications raise that risk. But in research published for the AIDS meeting, scientists at Massachusetts General Hospital uncovered another reason.

They scanned the arteries of people with and without HIV, and found the HIV patients had more inflammation inside their arteries, putting them at risk for the kind of clots that trigger heart attacks. That's even though the HIV patients had their virus well-controlled and weren't that old ? their average age was 52, the researchers reported in the Journal of the American Medical Association.

HIV triggers body-wide inflammation as a person's immune system tries to fight the virus, a process that persists and can quietly damage organs even with good medications, CDC's Fenton said.

HIV is not acting in a vacuum, said Dr. Amy Justice of Yale University, noting that people's histories of smoking, for example, also contribute to inflammation.

But she pointed to data from a Veterans Affairs study that said older people with HIV use more medications for other diseases than HIV-free patients the same age.

At the conference, some older people with HIV lined up to have their photographs made and their personal histories recorded, part of a Web project called "The Graying of AIDS."

It's a chance to be counted, and share knowledge.

"We're so concerned about the youth factor, we forget about the people who've brought us thus far," said Massey, the Maryland woman, who leads an HIV group called Older Women Embracing Life and works with churches to raise HIV awareness.

CDC's Fenton noted that those voices can help other older adults realize they're at risk, when they're getting back onto the dating scene after years of monogamous relationships. Older people don't use condoms as much as younger people.

"We still have this huge issue with stigma so thick you can cut it with a knife," says Massey, who also wants HIV testing to become a routine part of health check-ups. "We have to normalize the conversation."

Giant-killing Japan stun Spain

Japan scored one of the greatest upsets in Olympic football history Thursday after stunning reigning world and European champions Spain 1-0 at Hampden Park.

A first-half goal from Yuki Otsu secured a famous victory for Japan that revived memories of their famous Olympic upset of mighty Brazil at the 1996 Games in Atlanta.

With a young side bolstered by the likes of Jordi Alba and Juan Mata, both members of Spain's victorious Euro 2012 squad, the Spanish had been expected to collect a straightforward three points in their opening Group D game.

However despite dominating possession 65 percent to 35 percent the Spaniards were rocked back by the ferocity of Japan's play throughout, and the Asians were well worth their victory.

Spain were left reeling on 34 minutes when Japan punished slack defending from a corner to score through Otsu.

Takahiro Ohgihara swung in an inviting corner from the right and Otsu managed to get goalside of Martin Montoya to jab a low shot past the stranded Manchester United goalkeeper David De Gea.

Japan's players celebrated wildly and it got worse for Spain just before half-time when defender Inigo Martinez was sent off after a clumsy tangle with Kensuke Nagai.

The dismissal looked harsh but Martinez was clearly grabbing a handful of Nagai's shirt so could have few complaints with the decision.

Japan continued to look threatening after the break and should have made the game safe in the final few minutes only for Nagai and Hotaru Yamaguchi to squander golden chances.

Nagai ought to have found the net when clean through, only for De Gea to save two minutes from time.

Then in injury time, Yamaguchi blazed high and wide with the goal at his mercy after another swift Japanese counter-attack.

Mars orbiter repositioned to phone home Mars landing

ScienceDaily (July 25, 2012) ? NASA's Mars Odyssey spacecraft has successfully adjusted its orbital location to be in a better position to provide prompt confirmation of the August landing of the Curiosity rover.

NASA's Mars Science Laboratory spacecraft carrying Curiosity can send limited information directly to Earth as it enters Mars' atmosphere. Before the landing, Earth will set below the Martian horizon from the descending spacecraft's perspective, ending that direct route of communication. Odyssey will help to speed up the indirect communication process.

NASA reported during a July 16 news conference that Odyssey, which originally was planned to provide a near-real-time communication link with Curiosity, had entered safe mode July 11. This situation would have affected communication operations, but not the rover's landing. Without a repositioning maneuver, Odyssey would have arrived over the landing area about two minutes after Curiosity landed.

A spacecraft thruster burn Tuesday, July 24, lasting about six seconds has nudged Odyssey about six minutes ahead in its orbit. Odyssey is now operating normally, and confirmation of Curiosity's landing is expected to reach Earth at about 10:31 p.m. PDT on Aug. 5 (early Aug. 6, EDT and Universal Time), as originally planned.

"Information we are receiving indicates the maneuver has completed as planned," said Mars Odyssey Project Manager Gaylon McSmith of NASA's Jet Propulsion Laboratory, Pasadena, Calif. "Odyssey has been working at Mars longer than any other spacecraft, so it is appropriate that it has a special role in supporting the newest arrival."

Two other Mars orbiters, NASA's Mars Reconnaissance Orbiter and the European Space Agency's Mars Express, also will be in position to receive radio transmissions from the Mars Science Laboratory during its descent. However, they will be recording information for later playback, not relaying it immediately, as only Odyssey can.

Odyssey arrived at Mars in 2001. Besides conducting its own scientific observations, it has served as a communication relay for NASA's Spirit and Opportunity Mars rovers and the Phoenix lander on the Martian surface. NASA plans to use Odyssey and the Mars Reconnaissance Orbiter as communication relays for Curiosity during that rover's two-year prime mission on Mars.

Odyssey and the Mars Science Laboratory, with its Curiosity rover, are managed for NASA's Science Mission Directorate in Washington by JPL, a division of the California Institute of Technology in Pasadena. Curiosity was built at JPL.

Lockheed Martin Space Systems in Denver built Odyssey. JPL and Lockheed Martin collaborate on operating Odyssey.

Teaching with Portals: Why Gaming may have Educational Value ...

If you are a gamer, at least one who is not exclusively tied to consoles, this last week was potentially painful. It was a blissful sort of pain, though, since Steam?s now famous Summer Sale happened. Many gamers flock and buy what would constitute tons of discs worth of entertainment, were it not entirely digitally based. Valve, the company behind Steam, can barely keep up with the server strain, and with good reason. A number of people picked up Portal 2, a game I?m more than familiar with. But the game is starting to pick up, well, a bit of steam within the educational community.

Valve is offering what they are calling ?Teach with Portals,? a free version of Portal 2 and a Portal 2 Puzzle Maker, intended to allow teachers to provide a sort of digital testing ground for a variety of subjects: physics, math, chemistry, game design, language arts, and more. I?ve suggested before that thoughtfully interacting with games could provide a number of benefits, including a shared world and setting to discuss ethical issues. I suspect many students in high school will already be familiar with the game, so finding a way to encourage students to learn while playing something they already enjoy seems like a pretty solid plan. Some of my fondest memories from elementary school include playing Oregon Trail, though I can?t for the life of me remember what lesson I was supposed to learn there, though I suspect it had to do with avoiding dysentery. I did learn quite a bit from the typing game we played, though I can?t remember what the game itself was called.

Here?s the kicker, though. I?m pretty sure that this is not only a winning strategy, but one that makes me excited about pursuing teaching. This isn?t because I want to play games in class; I?m actually just excited that a medium I enjoy is becoming sophisticated enough technologically to be useful. Aside from the physics simulation, however, I am glad to see ?language arts? on the list of subjects Valve believes you could teach with Portal 2. I find studying literature fascinating, and video games have mostly been lacking in this area. We?ve come a long way since the story line stopped at ?A giant reptile has captured a princess, so the plumber had better go save her? which, I have to admit, sounds more like a mad-lib than perhaps the most famous video game series in history. The realm of role-playing games had better stories, or at least ones that were more involved. But rarely did the writing of games have the wit of the?Portal series, the emotional weight of?the?Mass Effect games, or even the action-movie level of madness of the now yearly installments of Call of Duty.?

But?Portal is not unique for its wit and clever writing. On that Steam sale I mentioned earlier, I picked up?Quantum Conundrum.?It was designed by Kim Swift, the creative director behind?Portal, not to mention working on Half-Life 2, both Left 4 Dead games, and the weirdly titled Fat Princess. It is clear that?Quantum?borrows heavily from Portal?s style: we get rooms of puzzles and a nearly omniscient voice directing us (voiced by none other than John de Lancie). The game is far cuter than its spiritual predecessor, but the wit is all there. There are a number of books lying around with names like ?Henry ^8? and ?Beowatt.? So far the game is a bit more of a platformer than a puzzle game. That is, it takes more raw skill than Portal did, but ends up feeling a bit more like a traditional game.

This recent push of ?smart? games strikes me as mostly a good thing. Of course, we don?t want to encourage our children to become addicted to video games, but recognizing their strengths will aid us in wading through a world that is saturated with digital goods. Even if our schools don?t immediately pick up ?teaching through games,? we can use games to teach those who already play them. Sometimes, you just have to ask the right questions.

Stocks plunge on European debt worries

NEW YORK - Fear over European debt surged Monday and drove stocks sharply lower around the world. The Dow Jones industrial average plunged more than 220 points in early trading.

The price of crude oil dropped more than $3.50 per barrel to below $90, and yields for U.S. government bonds sank to record lows, a sign that traders were seeking the safety of American debt. The euro hit a two-year low against the U.S. dollar.

Borrowing costs rose sharply for Spain and Italy, a signal of renewed investor worries that the Spanish government will need an international bailout.

Spain's market regulator said it was temporarily banning short-selling of shares on its stock indexes. In a short sale, an investor seeks a profit by betting that the price of a certain stock will fall.

Strong selling rattled European markets. The main stock index dropped more than 7 percent in Greece, 3 percent in Spain and Germany and 2 percent in France and Britain. Asian stocks were also sharply lower.

In the United States, the Dow was down as much as 225 points. At 9:40 a.m. EDT, it was off 215 points at 12,605. The Dow has had only four declines of 200 points this year, including its worst, a 274-point drop on June 1.

The Standard & Poor's 500 index fell 21 points to 1,340, and the Nasdaq composite index plunged 66 points to 2,859.

Bank stocks, which tend to take a hit when fear flares in Europe, were among the biggest losers. Citigroup stock dropped more than 2 percent and Bank of America 1.6 percent.

The euro slipped just below $1.21 against the dollar, its lowest reading since June 2010.

There were also signs that a global economic slowdown is hitting U.S. companies that rode out the recession fairly well, largely because currencies overseas have tumbled against the dollar.

While global sales at McDonald's restaurants open at least a year rose 3.7 percent, profits slid by about the same rates due to currency exchange.

Stock in the world's largest hamburger chain slid 2 percent in premarket trading after falling short of most Wall Street expectations for both net income and revenue.

A forecast from a Chinese central bank adviser that China's economy could grow at a slower pace in the third quarter deepened concerns about the global slowdown.

Gunman kills 12 in rampage at "Batman" premiere in Colorado

AURORA, Colo. (Reuters) - A gunman wearing a full suit of tactical body armor, a helmet and a gas mask opened fire at a packed midnight showing of the new "Batman" film in a Denver suburb on Friday, killing 12 people after setting off two smoke bombs in the dark theater.

Armed with an assault rifle, a shotgun and a pistol, the black-clad gunman wounded 58 others in the shooting rampage at a showing of "The Dark Knight Rises" at a mall in Aurora, turning the movie screening into a chaotic scene of dead or bleeding victims, horrified screams and pleas for help, witnesses said.

Police said 30 people remained hospitalized on Friday evening, 11 of them in critical condition.

Officers who arrived on scene within 90 seconds of the first emergency calls quickly took suspect James Eagan Holmes, 24, into custody in a parking lot behind the cinema, where he surrendered without a fight, Aurora Police Chief Dan Oates said.

Holmes, a graduate student who authorities said had his hair dyed red and called himself "the Joker" in a reference to Batman's comic-book nemesis, was due to make an initial court appearance on Monday.

Police declined to say what, if anything, Holmes said to them following his arrest. During an emotional press conference, Oates would not comment on possible motives for the massacre that stunned the community and the nation.

Authorities were unable to enter Holmes' apartment on Friday, saying he had booby-trapped it with what appeared to be sophisticated explosives. Police evacuated five nearby buildings and created a perimeter of several blocks and said they planned to detonate the suspected explosives with a robot on Saturday.

Meanwhile, police used dogs to search three buildings in a research complex at Anschutz Medical Campus at the University of Colorado at Denver where Holmes had worked. A university spokeswoman said nothing suspicious was found.

Witnesses at the movie theater told of a horrific scene, with dazed victims bleeding from bullet wounds, spitting up blood and crying for help. Among those taken to hospitals as a precaution was a baby boy just a few months old.

"I slipped on some blood and landed on a lady. I shook her and said, 'We need to go; get up,' and there was no response, so I presumed she was dead," said Tanner Coon, 17.

FUZZY PORTRAIT OF SUSPECT

Confusion reigned as shooting broke out during an action scene in the summer blockbuster. The suspect may have blended in with other moviegoers who wore costumes as heroes and villains, and some witnesses said they believed at first that his appearance was a theatrical enhancement to the film.

"It was just straight chaos," said Jennifer Seeger, 25. "Everybody was starting to scream and run at that point. He went straight from here to here with a gun in my face at that point. That rifle was in my face and I honestly didn't know what to think."

The shooting evoked memories of the 1999 massacre at Columbine High School in Littleton, 17 miles from Aurora, where two students opened fire and killed 12 students and a teacher.

It also resonated in the U.S. presidential race. Both President Barack Obama and his Republican rival, Mitt Romney, toned down their campaigns, pulled their ads from Colorado and dedicated their scheduled events to the victims.

"My daughters go to the movies," Obama told supporters at a campaign event in Fort Myers, Florida. "What if Malia and Sasha had been at the theater as so many kids do each day?"

The gunman was armed with an AR-15 assault rifle, a 12-gauge shotgun and a Glock .40-caliber handgun, Oates said. Police found an additional Glock .40-caliber handgun in his car, parked just outside the theater's rear emergency exit, Oates said.

He was dressed entirely in black with a gas mask, ballistic helmet, tactical ballistic vest, throat guard, leggings and crotch guard, Oates said, adding that Holmes had purchased the weapons legally at three area gun stores in the last 60 days and had bought 6,000 rounds of ammunition.

A law enforcement official who asked to remain anonymous said the suspect had purchased a ticket, entered the theater and propped open the emergency exit while he slipped out to "gear up" and return armed.

The portrait of Holmes that emerged in the hours following the shooting remained fuzzy, with only a speeding ticket on his record and nothing to suggest he was capable of an outburst of gun violence.

'SOCIALLY AWKWARD'

He grew up in a middle-class San Diego neighborhood and earned a degree in neuroscience from the University of California at Riverside before seeking his graduate degree from the University of Colorado.

People who knew him described him as kind toward children but said he had trouble finding work.

Holmes was described as bright but was in the process of dropping out of his graduate program at the time of the shooting, according to the university.

Billy Kromka, a pre-med student at the University of Colorado at Boulder who served as a research assistant alongside Holmes for several months last year, said he was astonished at the news.

"He basically was socially awkward but not to the degree that would warrant suspicion of mass murder or any atrocity of this magnitude," Kromka, 19, said. "I did not see any behavior he exhibited that indicated he would be capable of an atrocity of a magnitude like this."

Kromka said Holmes never talked politics or became animated about any particular subject, but appeared to be influenced by movies and the media and played online role-playing video games.

But New York Police Commissioner Ray Kelly said he "clearly looks like a deranged individual."

"He had his hair painted red. He said he was The Joker, obviously the enemy of Batman," Kelly told reporters, referring to a character in the Batman comic and cinematic universe known for committing acts of random, chaotic violence.

'GONE NOT FORGOTTEN'

Holmes' family issued a statement of sympathy for the victims, saying, "Our heart goes out" to their loved ones, while they also asked for privacy from the media while they "process this information.

Meanwhile, as darkness fell across Denver, a row of prayer candles and a dozen or so bouquets of flowers were clustered under a single hand-written sign that read: "7/20 gone not forgotten."

The theater remained cordoned off with police vehicles lining the perimeter, and Oates said officers would be on hand for future showings of "The Dark Knight Rises" in the city.

In New York, police pledged to deploy officers at all 40 theaters where the film was playing, partly as a precaution against "copycats." Los Angeles police said they would increase patrols at screenings of the film.

The Paris movie premiere was cancelled on Friday, event organizers said. Director Christopher Nolan called the shooting an "unbearably savage" event for which he expressed "profound sorrow" to the victims and their families.

Time Warner-owned Warner Bros, the studio behind the film, faced the prospect of seeing the blockbuster sink at the box offices even as the film got off to a strong start across the United States and Canada.

The film, with a budget of $250 million, opened on 4,404 screens, the second-widest release ever behind "Twilight: Eclipse," and industry analysts had said it stood a good chance of matching or beating the opening weekend box office record of $207 million set by Disney's "Avengers" in May.
